By accessing, downloading, installing, or using AI Surfer OS (the "Software"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Software.

1. Open-Source Software

AI Surfer OS is provided as open-source software. You are free to use, modify, and distribute the Software in accordance with its license. The Software is provided to you in its current state, and The AI Surfer makes no representations about its suitability for any particular purpose.

2. Assumption of Risk

You acknowledge and agree that:

• The Software connects to third-party services, APIs, and platforms on your behalf.
• The Software may execute AI-generated actions, including but not limited to sending messages, making API calls, modifying files, and interacting with connected applications.
• AI-generated outputs and actions may be inaccurate, incomplete, or unintended.
• You are solely responsible for reviewing, approving, and overseeing all actions taken by the Software and any AI agents running within it.
• You are solely responsible for any API keys, credentials, tokens, or account access you provide to the Software.

3. No Warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE AI SURFER DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AI SURFER, ITS FOUNDERS, EMPLOYEES, AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES ARISING FROM:

• Actions taken by AI agents on your behalf.
• Unauthorized access to or alteration of your data, accounts, or transmissions.
• Loss, corruption, or exposure of API keys, credentials, or personal data you provide to the Software.
• Third-party services accessed or modified through the Software, including but not limited to email, calendar, CRM, payment, and social media platforms.
• Financial losses resulting from automated transactions, communications, or data modifications.
• Any actions taken by connected applications (such as Composio, OpenRouter, Vapi, or similar services).

5. Third-Party Services

The Software may integrate with third-party services including, but not limited to, Composio, Google Gemini, OpenRouter, Vapi, xCloud, OpenAI, Anthropic, and others. These services are governed by their own terms of service and privacy policies. The AI Surfer is not responsible for the availability, accuracy, or conduct of any third-party service, and your use of them is at your own risk.

6. Your Responsibilities

You agree to:

• Use the Software in compliance with all applicable laws and regulations.
• Not use the Software for any unlawful, harmful, or abusive purpose.
• Safeguard your own credentials, API keys, and account access.
• Monitor and supervise AI agent activity running on your server.
• Accept full responsibility for any consequences arising from your use of the Software.

7. Indemnification

You agree to indemnify, defend, and hold harmless The AI Surfer, its founders, employees, affiliates, and contributors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Software, your violation of these Terms, or your violation of any rights of a third party.

8. License Keys & Access

License keys are issued for use on a single server. Keys have a defined duration and may expire. An expired key does not affect the operation of your installed Software but will prevent you from receiving updates. The AI Surfer reserves the right to revoke or suspend keys at its discretion.

9. Changes to These Terms

The AI Surfer reserves the right to modify these Terms at any time. Updated terms will be posted at this URL. Your continued use of the Software after changes are posted constitutes acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
